Welcome to Indiana Bears Merchandise ("we," "us," "our"). These Terms of Service govern your use of https://shop.IndianaBearsProgress.com and any purchase you make through it.

By browsing this site or placing an order, you agree to these terms. If you don't agree with them, please don't use the site.

1. Who can use this store

You must be at least 18 years old, or be the age of majority in your state or province, to make a purchase. If you're a minor, you may use this site only with the involvement and consent of a parent or guardian.

You agree not to use our products or site for any unlawful purpose, and not to violate any laws in your jurisdiction while doing so.

2. Not affiliated with the Chicago Bears or the NFL

Indiana Bears Merchandise is an independent, fan-operated store. We are not affiliated with, endorsed by, sponsored by, licensed by, or connected in any way to the Chicago Bears Football Club, the National Football League, NFL Properties LLC, or any of their affiliates, subsidiaries, or licensees.

All team names, league names, logos, and trademarks referenced anywhere on this site are the property of their respective owners. Any use of such names is for identification and commentary purposes only and does not imply any association or endorsement.

Our products are original fan-made designs expressing regional support and interest. They are not official team merchandise, and we make no claim that they are.

3. Our content and designs

All original artwork, designs, graphics, product photography, text, and layout on this site are our property or used with permission, and are protected by copyright and other applicable law.

You may not reproduce, copy, resell, redistribute, or create derivative works from our designs without written permission. Buying a product gives you ownership of that physical item — it does not transfer any rights in the design printed on it.

4. Products, descriptions, and pricing

Our products are made to order. We try to display colors, sizing, and details as accurately as possible, but we can't guarantee that what you see on your screen matches the physical product exactly. Screen calibration varies, and heather and blended fabrics in particular can differ in tone from their mockups.

Product measurements are approximate and may vary slightly between items.

We reserve the right to modify or discontinue any product at any time, and to change prices without notice. We're not liable to you or anyone else for any modification, price change, or discontinuation.

Pricing errors: If a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel the order and refund you in full, even if the order was already confirmed.

5. Orders

Submitting an order is an offer to buy, not a completed contract. We may refuse or cancel any order, and we may limit quantities per person, per household, or per order.

We may cancel orders that appear fraudulent, that we believe are placed by resellers or distributors, or that we cannot fulfill for any reason. If we cancel your order, we'll notify you and refund you in full.

You agree to provide current, complete, and accurate purchase and account information, including a valid email address and shipping address, so we can complete your order and contact you if needed.

6. Shipping and returns

Shipping timelines, rates, and delivery terms are set out in our Shipping Policy.

Refunds, replacements, and claims are governed by our Refund & Return Policy.

Both policies are incorporated into these Terms by reference.

7. Reviews, comments, and submissions

If you send us ideas, feedback, reviews, photos, or other material — whether we asked for it or not — you agree we may use, edit, publish, and share it without restriction or compensation to you.

You agree that anything you submit won't violate anyone else's rights, won't contain unlawful, abusive, defamatory, or obscene material, and won't contain malware or false information. We may (but aren't obligated to) remove any submission for any reason.

8. Prohibited uses

You may not use this site or its content to: break any law; infringe anyone's intellectual property; harass, abuse, or discriminate; submit false information; upload malicious code; scrape or harvest data; interfere with the security features of the site; or attempt to gain unauthorized access to any part of it.

We may terminate your access for violating any of the above.

9. Accuracy and availability of the site

We do our best to keep information on this site current, but we don't warrant that it's accurate, complete, or error-free. Material here is provided for general information and shouldn't be relied on as your sole basis for decisions.

We don't guarantee uninterrupted or error-free access to the site, and we may suspend or discontinue any part of it at any time without notice.

10. Third-party services

Our site relies on third parties including Shopify for hosting and checkout, payment processors, print providers, and shipping carriers. We're not responsible for the products, services, or practices of these third parties, and your use of them may be governed by their own terms.

Any links to third-party sites are provided for convenience. We don't endorse them and aren't responsible for their content.

11. Disclaimer of warranties

To the fullest extent permitted by law, our products and this site are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the products will meet your expectations, or that the site will be secure, uninterrupted, or error-free.

Some jurisdictions don't allow the exclusion of certain warranties, so some of the above may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, Indiana Bears Merchandise and anyone acting on its behalf will not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of this site or any product purchased through it.

Where liability cannot be excluded, our total liability to you for any claim will not exceed the amount you actually paid for the product giving rise to the claim.

Some jurisdictions don't allow these limitations, so they may not fully apply to you.

You agree to indemnify and hold harmless Indiana Bears Merchandise and its operators from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

If any provision of these Terms is found unenforceable, that provision will be enforced to the fullest extent permitted, and the remaining provisions stay in full effect.

15. Changes to these Terms

We may update these Terms at any time by posting a revised version on this page. Changes take effect when posted. Your continued use of the site after changes are posted means you accept them.

The "Last updated" date at the top tells you when this was last revised.

16. Governing law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of law provisions. Any dispute will be brought in the state or federal courts located in Lake County, Indiana, and you consent to that jurisdiction.
